Overland Garden Apartment

we wanted a two bedroom apartment, so a friend told me about the Overland Garden apartment which is suppose to be a place for low income earners.We got there in the month of Febuary, and I was asked to fill out an application,and that I accompany it with our children birth certificate,our social security cards,I.D cards which I did, and I paid the sum of $90.00 for me and my husband's applications.Then we were ask to pay another holding fee of $100.00 which they said will be added to our security deposit if we get approved.They checked our credit and criminal history,verified our earning from our employers,and also verified our account with our banks. Eventually, they called us on Friday evening of March 14th, 2013 at 3pm to come pay and sign the lease that we are approved,but we couldn't go that day because I was on my way to work and my husband was taking the kids for doctor's appointment. The next day which was on Saturday, I made money order of $1117.00 and gave Ms Anita for the rent bill.Mrs Nita gave us forms,which she highlighted and asked us to sign,we refused and asked her to go show us the apartment. She said she is very busy because they are working less in the office that day, so she cannot leave the office to go show us the place.She insisted that we should sign the forms and move in that it will not count since is weekend,then we come back on Monday so we can finish up,so we signed based on what she told us.She gave us the key,and we all drove close to the apartment. She walked us down to the apartment,and she showed me how to open the apartment and she left hurriedly. That was when I began to suspect that something was wrong.We went in and saw that the place was a mess.For example the bathtub was so messy,the kitchen sink cracked, and the worst of all is the carpet,they are so dirty even though they try to clean them up with a chemical that made my daughters so sick because it was shocking. Immediatelly, we called that we don't like the place, and that we are not moving in,and the answering person answered and sent an e-mail. Surprisingly,she called my cell phone on Monday morning and said that what they have available was three bedroom apartment,I told her that we cannot afford a three bedroom apartment.Then she said that's all she can do for me,I said I want my money back.She set an appointment to meet with the manager which my husband did, but the manager told him that they cannot refund us our money.
